Terms of Service

Introduction
Thanks for using GardenMap. GardenMap is a service provided by
Skyber Solutions Ltd (“GardenMap”, “we” or “us”), a limited
company (UK reg # 09354010) registered at Trenedden Barn,
Lansallos, Looe, Cornwall, PL13 2QE, UK.
These GardenMap Terms of Service (which we refer to as the
“Terms”) cover your use of and access to GardenMap and your
content in GardenMap.
Your use of GardenMap requires that you agree to the Terms. Please
read them carefully. If you do not understand the Terms, or do not
accept any part of them, then you should not use GardenMap.
Your use of GardenMap
Age Restrictions. In order to use GardenMap you must be 13 years of age or older.
Your Conduct. Don’t misuse GardenMap. You are responsible for your conduct and your content stored in GardenMap. We may review your conduct and content in GardenMap for compliance with the Terms.
Your Content. GardenMap allows you to upload, submit, store, send and receive content. You retain ownership of any intellectual property rights that you hold in that content.
When you upload, submit, store, send or receive content to or through GardenMap, you give us a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our services, and to develop new ones. This license continues even if you stop using our services unless you delete your content. Make sure you have the necessary rights to grant us this license for any content that you submit to GardenMap.
You agree that when you upload, submit, store, send or receive content to or through GardenMap the content is not:
- false or misleading;
- any information likely to be deemed threatening, disparaging, defamatory, pornographic, racially or ethnically offensive, discriminatory, insulting, slanderous or otherwise illegal or inappropriate;
- an infringement of the intellectual property (including copyright), publicity or privacy rights of any third party or otherwise violate such third party's rights;
- information that you are not legally entitled to distribute (such as insider information or confidential information);
- any unsolicited or unauthorised advertising, promotional material, "junk mail", "spam", "chain letters", "pyramid schemes" or any other form of solicitation; and

software virus or any other technology that may harm the
Services, or the interests or property of our Services or the
other users of the Services.
GardenMap welcomes the opportunity to be notified of any objectionable or unauthorized use of Content, and users, rights holders and licensees are invited to inform us of any potential violations at hello@gardenmap.com.
Sharing. Sharing settings in GardenMap allow you to control what others can do with your content in GardenMap. By default you are the owner, and sole editor and viewer of content you create or upload to GardenMap. You can choose to share your content and can transfer control of your content to other users.
Service access. You acknowledge that you are fully responsible for the internet connection and/or mobile charges that you may incur for using our Services. Please consult your carrier, mobile operator, etc. for further information.
Privacy Protection
The GardenMap Privacy Policy explains how we treat your personal data and protect your privacy when you use GardenMap. By using GardenMap, you agree that we can use such data in accordance with our Privacy Policy.
Cookies
When you visit or interact with our Services, GardenMap or our Services providers use cookies to store certain types of information for each time you visit or interact with our Services. By using GardenMap you agree to us using cookies in accordance with our Cookie Policy.
GardenMap Software
Client Software. GardenMap includes downloadable client software (“Software”). This Software may update automatically on your device once a new version or feature is available. We give you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the Software provided to you by us as part of GardenMap. This license is for the sole purpose of enabling you to use and enjoy the benefit of GardenMap as provided by us, in the manner permitted by these Terms. You may not copy, modify, distribute, sell, or lease any part of GardenMap or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
Modifying and Terminating GardenMap
Changes to GardenMap. We are constantly changing and improving GardenMap. We may make performance or security improvements, change functionalities or features, or make changes to comply with law or to prevent illegal activities on, or abuse of, our systems. We will provide notice of material changes to GardenMap that we reasonably believe will adversely impact your use of GardenMap. However, there are times when we will need to make changes to GardenMap without giving notice. These will be limited to instances where we need to take action to ensure the security and operability of the service, prevent abuse or where we must act to meet legal requirements.
Suspension and Termination. You can stop using GardenMap at any time. We may suspend or permanently disable your access to GardenMap if you materially or repeatedly violate our Terms.
Discontinuation of GardenMap. If we decide to discontinue GardenMap, we will give you at least 60 days’ prior notice. During this notice period, you will have the opportunity to take your content out of GardenMap. After the end of this 60 day period you will not be able to access your content. We believe that you own your content and preserving your access to such content is important. For instructions on how to download your content, please contact us at hello@gardenmap.com.
iOS GardenMap App
If you choose to purchase in-app subscription services, you must provide information about your preferred payment method. If you paid through the iTunes store, you may change your payment method through the corresponding store account. All purchases are final and no refunds or credits will be provided. Subscription fees will be billed automatically at the start of the monthly or annual period, as applicable. The subscription fees will auto-renew until they are downgraded or terminated.
Your fees will be the same as your initial charges unless you are otherwise notified in advance.
You authorise Apple to charge your payment method for the appropriate fees and for any other purchases you make via the App.
You may cancel your auto-renewal at any time. You may be entitled to change your mind and receive a full refund within 14 days, you can submit a refund request to Apple – for further details please see Apple’s terms of use.
You may cancel your subscriptions by visiting the subscription management options within iOS. The cancellation of a membership will go into effect at the end of your current billing cycle and you will have the same level of access to the App through the remainder of the billing cycle. When your subscription ends, your account will return to free ‘Garden Explorer’ mode. You can renew your subscription at any time.
Users that downloaded the free version of a subscription using a redeemable code will not automatically be charged for a new subscription and will have the option to purchase a subscription at the end of the free period.
Our Warranties and Disclaimers
We provide GardenMap using a reasonable level of skill and care and we hope that you will enjoy using GardenMap. But there are certain things that we don’t promise about GardenMap. Other than as expressly stated, we don’t make any commitments about the specific functionality available through GardenMap, its reliability, availability, or ability to meet your needs.
Liability and indemnity
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
The total liability of GardenMap, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the services (or, if the subject of the claim is the free service, to supplying you the services again).
GardenMap, including its partners, affiliates, contractors, officers, directors, employees, and agents, shall not be liable for any loss of profit, loss of data or any other indirect damages in connection with the Services or otherwise under these Terms.
You agree to indemnify and hold GardenMap, its partners, affiliates, contractors, officers, directors, employees and agents harmless from and against any and all claims, losses, liabilities, expenses and damages related to your breach of these Terms.
As a consumer you have special rights under mandatory consumer laws and regulations. We do not intend to limit or alter such rights under these Terms. Further we do not intend to impose a greater responsibility on you than you have under mandatory consumer laws and regulations.
Laws Governing the Terms
The laws of the United Kingdom will apply to any disputes arising out of or relating to these Terms or GardenMap. We both agree that the courts of the United Kingdom shall have non-exclusive jurisdiction to settle any disputes arising out of or relating to these Terms or GardenMap.
About these Terms
These Terms represent the entire agreement between you and GardenMap relating our Services, and replaces all earlier agreements and understandings between you and us.
We may modify these Terms at any time. You should look at the Terms regularly. We’ll post notice of modifications to these Terms on this page. If you do not agree to the modified terms you should discontinue your use of GardenMap.
If it turns out that a particular term is not enforceable, this will not affect any other terms.
